Offer picked up a piece of metal to complete his work. However, this metal piece had been used by someone else for dismantling the axle of another tractor, and had developed a rough edge due to the use. Although Offer was wearing safety gloves, a tendon in his right hand was severed by the metal. This has made his hand numb for life, and he cannot withstand cold anymore. He underwent surgery and attended physiotherapy sessions, but in vain. His treatment forced him to stay out of work for three months.
Offer is currently working as a driver but is scared of losing his job if his health goes worse. He fears that if he loses this job, he may not be able to find another in the present economic climate.
After Offer’s accident, his union Unite directed Thompsons Solicitors to sue DSV Road for damages. However, the company agreed for an out-of-court settlement and paid 25,000 pounds for its failure to provide proper tools to Offer.
